1. Agreement to These Terms
These Terms of Use (“Terms”) govern your access to and use of Orvyx VPN (“Orvyx,” the “Service”), operated by AFNATO (SMC-Private) Limited (“we,” “us,” or “our”).
By downloading, accessing, purchasing, or using Orvyx VPN, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. Eligibility
You must be legally permitted to use the Service in your location and capable of entering into a binding agreement under applicable law.
You are responsible for complying with laws applicable to your use of VPN services.
3. The Orvyx VPN Service
Orvyx provides virtual private network connectivity that routes internet traffic through VPN infrastructure made available to Orvyx.
The Service may include:
- VPN connectivity;
- access to available VPN locations;
- Quick Connect functionality;
- supported VPN protocols;
- account and subscription management; and
- related security and connectivity features.
Available locations, servers, protocols, features, and infrastructure may change from time to time. We do not guarantee that a particular VPN server, country, protocol, IP address, or feature will remain available permanently.
4. Accounts and Personal Use
Orvyx may create an account identifier when you begin using the Service. You may also have the option to link or recover your account using Sign in with Apple.
Orvyx VPN is provided for personal, non-commercial use only.
You are responsible for maintaining appropriate control over devices and credentials used to access your Orvyx account.
You may not resell, sublicense, commercially redistribute, share for commercial purposes, or otherwise provide access to Orvyx VPN as part of another service without our prior written permission.
5. Free and Premium Access
Certain Orvyx features may be available without a paid subscription, while other features require an active Premium subscription.
The features available under free or Premium access may change over time. Any material changes affecting an active paid subscription will be handled in accordance with applicable law and Apple’s subscription requirements.
Auto-Renewable Subscriptions
Orvyx may offer auto-renewable subscriptions, including monthly and yearly plans. Subscriptions purchased through the iOS application are processed by Apple through the App Store.
The subscription price, billing period, any introductory offer, and applicable taxes are displayed by Apple before you confirm your purchase.
Unless cancelled, an auto-renewable subscription will renew according to the billing period shown at purchase. Your Apple account will be charged according to Apple’s applicable subscription terms.
You can manage or cancel your subscription through your Apple account or App Store subscription settings.
Free Trials and Promotional Offers
Orvyx may offer free trials, introductory pricing, promotional offers, or other subscription incentives to eligible users.
Eligibility, duration, price following the offer, and other applicable conditions will be shown before purchase. Promotional offers may be limited to eligible users and may not be available to users who previously received the same or a similar offer.
Unless cancelled before the end of an applicable trial period, a subscription may automatically convert into a paid subscription at the price displayed before enrollment.
Cancellation and Refunds
Subscriptions purchased through Apple’s App Store must be cancelled through Apple. Cancellation generally prevents future renewals but does not necessarily terminate access immediately; you may continue to have access for the remainder of the paid subscription period, subject to Apple’s applicable rules.
Payments and refunds for App Store purchases are administered by Apple. Where you are legally entitled to a refund or other remedy, your statutory rights are not affected by these Terms.
6. Acceptable Use
You may use Orvyx only for lawful purposes and in accordance with these Terms. You are responsible for activity conducted through your use of the Service.
Use of a VPN does not exempt you from laws that otherwise apply to your conduct.
Prohibited Activities
You must not use Orvyx to:
- distribute malware, viruses, ransomware, or other malicious software;
- conduct unauthorized access, intrusion, scanning, exploitation, or attacks against systems or networks;
- engage in denial-of-service attacks or deliberate service disruption;
- distribute unsolicited bulk messages or spam;
- commit fraud, identity theft, or other unlawful deception;
- abuse, interfere with, or circumvent Orvyx security, authentication, subscription, or access controls;
- create accounts or transactions through unauthorized automation or manipulation;
- attempt to extract or misuse VPN credentials or infrastructure;
- resell or redistribute Orvyx access without authorization;
- use the Service in a manner that materially interferes with the Service for other users; or
- use Orvyx for activity prohibited by applicable law.
We may take proportionate action to protect users, our infrastructure, service providers, or third parties where abuse is detected.
7. VPN Performance and Availability
VPN performance can vary.
Factors outside our control may affect speed, latency, connection reliability, and availability, including:
- your internet connection;
- your internet service provider;
- geographic distance;
- network congestion;
- device conditions;
- selected protocol;
- VPN server availability;
- governmental or network restrictions; and
- third-party systems.
We do not guarantee uninterrupted, error-free, or constant-speed VPN connectivity. We may add, remove, replace, or maintain VPN servers and locations as reasonably necessary to operate the Service.
8. Third-Party Services and Infrastructure
Orvyx relies on third-party technology and infrastructure providers to operate portions of the Service.
Our VPN infrastructure is provided through GZ Systems Limited, d/b/a PUREVPN.
We also use providers including Apple, Supabase, Vercel, and Cloudflare for functions such as payments, authentication, backend services, subscription verification, hosting, and security.
Third-party services may be subject to their own terms and privacy practices.
Orvyx is not responsible for websites, applications, streaming services, networks, internet service providers, or other external services you access while connected to the VPN. We do not guarantee that any particular third-party service will permit VPN access or remain accessible through Orvyx.
9. Privacy
Your privacy is important to us. Our collection and processing of information is described in the Orvyx VPN Privacy Policy.
The Privacy Policy forms part of the terms governing your use of Orvyx.
10. Suspension and Termination
We may restrict, suspend, or terminate access to Orvyx where reasonably necessary because of:
- material violation of these Terms;
- fraud or attempted subscription abuse;
- security threats;
- serious or repeated misuse of the Service;
- legal requirements; or
- conduct that materially threatens Orvyx, our infrastructure, other users, or third parties.
Where reasonably appropriate, we may provide notice or an opportunity to resolve the issue. Termination by Orvyx does not override any rights you may have under applicable consumer law.
11. Account Deletion
You can initiate deletion of your Orvyx account from the Account section of the Orvyx VPN application by selecting Delete Account.
Account deletion is permanent and cannot ordinarily be undone. Certain information may be retained where reasonably necessary for legal, security, fraud-prevention, accounting, dispute-resolution, or similar lawful purposes, as described in our Privacy Policy.
Deleting your Orvyx account does not automatically cancel an App Store subscription.
12. Intellectual Property
Orvyx VPN, including its software, branding, interface, graphics, logos, text, and other proprietary materials, is owned by or licensed to AFNATO (SMC-Private) Limited and is protected by applicable intellectual-property laws.
These Terms give you permission to use the Service for its intended purpose. They do not transfer ownership of Orvyx or any underlying intellectual property to you.
You may not copy, modify, reverse engineer, redistribute, resell, or commercially exploit Orvyx except where such restriction is prohibited by applicable law or expressly authorized by us.
13. Changes to the Service
We may update, modify, improve, discontinue, or replace features of Orvyx from time to time.
We may also make changes necessary to:
- improve security;
- maintain compatibility;
- address abuse;
- comply with legal requirements;
- respond to infrastructure changes; or
- improve performance and reliability.
Where a change materially affects an active paid subscription, we will comply with applicable consumer and App Store requirements.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Orvyx is provided on an “as is” and “as available” basis.
We do not guarantee that:
- the Service will always be available or uninterrupted;
- every VPN server or location will always be accessible;
- every third-party website or service will work through the VPN;
- the Service will eliminate every security or privacy risk; or
- VPN performance will always meet a particular speed or latency level.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
15. Limitation of Liability
To the maximum extent permitted by applicable law, AFNATO (SMC-Private) Limited will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Orvyx.
This includes, where legally permitted, loss arising from interruption, loss of access, loss of data, third-party services, network conditions, or unauthorized use outside our reasonable control.
Our aggregate liability arising out of the Service will not exceed the amount you paid for Orvyx during the 12 months preceding the event giving rise to the claim, except where applicable law requires otherwise.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.
16. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses, claims, or costs arising from your unlawful use of the Service or a material violation of these Terms.
This provision does not apply where prohibited by applicable consumer law.
17. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to conflict-of-law principles.
Subject to any mandatory consumer rights that apply under the laws of your country of residence, the courts of Pakistan will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Orvyx VPN service.
Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.
18. Apple App Store Terms
If you obtain Orvyx through Apple’s App Store:
- these Terms are between you and AFNATO (SMC-Private) Limited, not Apple;
- Apple is not responsible for providing the Orvyx VPN service;
- App Store purchases and subscriptions are subject to Apple’s applicable payment and subscription terms;
- Apple may have rights as a third-party beneficiary of applicable application-license terms; and
- your use of the application is also subject to Apple’s applicable App Store usage rules.
Unless a separate custom end-user license agreement is provided through the App Store, Apple’s Standard Licensed Application End User License Agreement may also apply to the software license.
19. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will update the effective date and provide additional notice where required by applicable law.
Your continued use of Orvyx after updated Terms take effect constitutes acceptance where permitted by applicable law.
